Same Gender Marriage: Retroactivity; Plan Amendments

Description
It’s been over 9 months since the Supreme Court issued its famous Windsor decision, requiring the federal government to recognize same gender marriages. While the IRS gave us initial guidance in September, two important questions were left unanswered:
  1. What will be the deadline to amend plans to conform to Windsor?
  2. To what extent will plans be required to apply the Windsor decision retroactively?

The IRS has finally answered those two questions and more. In our special April 17 web seminar, we take a detailed look at the new guidance, with plenty of examples, and what it means for employers and their advisors. Our seminar answers these questions and more:

  • When do the new rules have to go into effect?
  • Can an employer put them into effect earlier?
  • How does same gender marriage affect plan operations?
  • Does the plan’s choice of law clause matter? What about the employer’s location?
  • Does the participant’s residence matter? If so, when?
  • Do the new rules apply to 403(b) plans?
  • What plans must be amended?
  • What is the deadline to amend plans?

As with all our seminars, we will provide attendees with an opportunity to receive answers to their own questions.

Prerequisites: The presenter will assume attendees are generally familiar with the operation of qualified defined contribution plans.

  1. List retirement plan issues affected by same gender marriage
  2. Apply the effective date provisions to specific plan situations

  4. Counsel with an employer about amendment alternatives
