The IRS is getting out of the determination letter business for individually designed plans, other than issuing letters when a plan is established and when it terminates. The effects of this decision can be profound on individually designed plans, and could carry over to preapproved plans (prototype and volume submitter). We still don’t know the full plans of the IRS; they have asked for comments in several areas. Those comments could affect the remedial amendment period and plan corrections.
