It focuses on legal principles which can apply to any plan, rather than on the specifics of any one plan document. Restatement Perspectives 09: Distribution Changes: Anti-cutback, 401(a)(4)

An important section of any plan document is the section dealing with distribution options. That is certainly an issue a practitioner should discuss with the employer to make sure that the document continues to meet the employer's needs.

Frequently, an employer wishes to add distribution options. That is fine. But sometimes, an employer needs or wants to take them away. And this is where the anti-cutback rule takes a hand. When can a plan move or modify existing distribution options? If it is protected, can the plan be changed going forward? If so, is there a problem with benefits, rights and features? This web seminar examines this difficult, technical issue from the perspective of the plan designer.

  • Limiting protected options
  • Effect on benefits, rights, features

 

Prerequisites: There are no prerequisites or advance preparation for this program. The instructor will assume attendees are familiar with preapproved plan documents and with the operation of 401(k) plans.
