****************************************************************

It's been over two decades since the IRS issued the nondiscrimination final regulations under Section 401(a)(4). "Detailed" doesn't begin to describe the mind-numbing 186 pages of government language in the final regulations. These rules intimately affect many aspects of plan operation and design. Pension practitioners must have a thorough understanding of the nondiscrimination rules.

This program outlines the nondiscrimination rules on defined contribution plans. Using clear analysis and examples, the speaker presents a clear path through the nondiscrimination rules. However, those who attend the seminar should already have a good understanding of the coverage rules, which is available in our Coverage program.

What You'll Learn:

  • Design-based safe harbors Effect of allocation conditions
  • Permitted disparity
  • General nondiscrimination test
  • Restructuring
  • Amendments
  • Correcting problems
Prerequisites: New pension practitioners should attend Segment 1: Coverage and Segment 2: HCE and Key Employee programs prior to this program. We will focus on defined contribution nondiscrimination, and because of the detailed nature of the topic, this program will not cover nondiscriminatory compensation or cross-tested plan designs.
