The topic of fee disclosure and “transparency” in qualified plan transactions continues to dominate the retirement plan landscape. Just three months ago the DOL released final regulations that mandate disclosures by various plan service providers of direct and indirect compensation the service providers will receive during the life of a service arrangement with the plan. The next major jolt to the foundations of retirement plan administration is the new set of mandatory disclosures for participant-directed individual account (e.g., 401(k)) plans.

In this Web seminar, we will review the fiduciary obligations under Title I of ERISA which have generated the new participant disclosure regulations. In aid of the obligation to discharge their duties solely in the best interest of participants, plan fiduciaries must ensure that participants are aware, on a regular and continuing basis, of their rights and responsibilities regarding the investment of assets held in their accounts.

The new regulations will require specific disclosures of the costs to participants of administrative services, and of fees and expenses associated with designated investment alternatives. The seminar will outline the requirements to disclose on initial eligibility, quarterly, and annually, the administrative expenses a participant may incur. In addition, the seminar will explain the detailed disclosure requirements relating to the performance of each designated investment alternative, including the format for the disclosures.
