We have the first set of final regulations under the new administration and they address automatic enrollment plans. We now have detailed rules on EACAs and QACAs. The new rules make numerous changes to the proposed regulations, many of which enhance flexibility or resolve questions and concerns. The new rules also reflect some recent changes in 401(k) corrections. The new regulations go into effect in 2010.

An automatic enrollment plan may be a good answer for many employers seeking to reduce matching contributions but still maintain employee deferrals. Under the final regulations, employers have more options than ever before on EACAs, which give the crucial ability to return automatic deferrals.     There are no prerequisites and no advance preparation required for this program. However, the instructor will assume participants have a basic familiarity with 401(k) plans, including classic safe harbor plans. The instructor will not assume prior familiarity with automatic contribution arrangements of any sort.
