Tax Reform and the 401(k) Plan

Fiscal cliff, raising the debt ceiling, raising taxes and revenue, and tax reform! These are phrases we have heard far too often during the past year! Unfortunately, there’s more to come as each phrase and the legislative action connected to it will have a significant impact on retirement plans.

The recent tax law enacted at the end of December 2012 raised taxes for some and provided an immediate tax planning tool for many – Roth transfers. Unlike the in-plan Roth rollover which was complicated and had limited application, the Roth transfer is easier to use and promises to have broader application. In this year’s Workshop, learn how to implement and do the recordkeeping for Roth transfers.

And Congress is far from done. Congress has promised more tax reform, and many experts fear that more reform will have substantial negative impact on retirement plans. SunGard’s 401(k) Plan Workshop 2013 discusses the likely tax reform changes, as well as possible solutions to help deal with the pending changes.

There is also change from the IRS, which just released a long-awaited update to its plan correction program, EPCRS. With lots of examples, we will describe the changes in EPCRS and how to utilize the program to make plan corrections. The workshop also will address how to use retroactive amendments (“-11(g) amendments”) to avoid plan disqualification.

For plans that find themselves in a disqualified status, we will explain the tax consequences, statute of limitations and how to re-obtain qualified status. The workshop also will include an interesting explanation of what the IRS likely will do with the information obtained in its recent surveys of 401(k) plans. Finally, we will explain how to identify, test and amend plan benefits, rights and features.
